General Terms and Conditions
Article 1. Applicability
These conditions apply to all deliveries and services of Stable Brothers BV when executing orders that do not originate from business customers or companies. Deviating and/or additional agreements must be expressly confirmed in writing by Stable Brothers BV; this also applies when the requirement for written confirmation is waived. Accepting offers or placing an order implies that you accept the applicability of these conditions.
Article 2. Offers / agreements
All offers from Stable Brothers BV are without obligation and Stable Brothers BV expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations. An agreement is only concluded after acceptance of your order by Stable Brothers BV. Stable Brothers BV is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Stable Brothers BV will notify this within 7 working days after receipt of the order. Stable Brothers BV excludes any liability or responsibility for any error or omission in the content of the website (shop) (or the website of third parties). All decisions made on the basis of information from website content are at your own expense and risk.
Article 3. Prices and payments
The prices stated for the products and services offered are in Euro, including VAT and excluding handling and shipping costs, any taxes or other levies, unless otherwise stated or agreed in writing. In the event that handling and/or shipping costs are charged, this will be explicitly stated with the relevant article. Stable Brothers BV offers various payment options. Advance payment: You can pay in advance. Your order will then be delivered after your payment has been received by Stable Brothers BV. In the event of advance payment, you can transfer the total amount to bank account NL17ABNA0875574343 Tnv Stable Brothers BV. Cash: You can pay in cash at the collection address. Credit card: You cannot pay with American Express, Eurocard Mastercard and Visa on the website. Ideal: You can authorize Stable Brothers BV once for the payment of your product(s) via your own trusted and secure payment website of your bank (Rabobank, ING, ABN Amro, Fortis, SNS Bank, SNS Regio bank, Friesland bank and Postbank). If the prices for the products and services offered increase in the period between the order and its execution, you are entitled to cancel the order or terminate the agreement within ten (7) days after notification of the price increase by Stable Brothers BV.
Article 4. Delivery
After receiving the product, you have a cooling-off period of 7 working days to cancel the agreement without giving reasons and to return or exchange the product. You must then report this in writing (by email or letter) within 7 working days and return the product (in original, complete and undamaged packaging) undamaged, complete and unused. You bear the costs and the risk of the return shipment yourself. If you have already made a payment, Stable Brothers BV will refund this payment within 30 days after receiving the returned goods. Stable Brothers BV applies a maximum delivery period of 30 days. If the ordered products are not delivered within 30 days, you have the option to cancel the purchase agreement. The delivery times stated by Stable Brothers BV are only indicative. Exceeding any delivery period does not entitle you to compensation. The delivery of the products takes place at the place and time when the products are ready for shipment to you. Stable Brothers BV is entitled to deliver in parts. The additional costs of subsequent delivery will be borne by Stable Brothers BV.
Article 5. Retention of title
Ownership of delivered products will only be transferred if you have paid everything you owe to Stable Brothers BV under any agreement. The risk regarding the products will already be transferred to you at the time of delivery.
Article 6. Intellectual and industrial property rights
You must fully and unconditionally respect all intellectual and industrial property rights that rest on the products delivered by Stable Brothers BV. Stable Brothers BV does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property right of third parties.
Article 7. Complaints and liability
You are obliged to examine whether the products correspond to the agreement upon delivery. If this is not the case, you must contact Stable Brothers BV as soon as possible and in any case within two (2) days after delivery, or after the discovery could reasonably have been made, at info@Stable Brothers BV Nl. If a product has a defect, the manufacturer/importer will determine whether the product will be repaired or replaced. If it is plausible that the defect is attributable to you or is otherwise at your expense and risk, the product will be returned in the same condition or repaired/replaced at your expense in consultation. The products supplied by Stable Brothers BV have a full manufacturer's warranty in accordance with the conditions set by the manufacturer concerned. The risk during transport of the product ordered by you is for Stable Brothers BV. At the time of delivery of the product, the risk of the product is transferred to you, except for the liabilities that cannot legally be excluded by Stable Brothers BV.
Article 8. Orders/communication
Stable Brothers BV is not liable for any misunderstandings, mutilations, delays or improper transmission of order data and communications resulting from the use of the Internet or any other means of communication in the traffic between you and Stable Brothers BV, or between Stable Brothers BV and third parties, insofar as this relates to the relationship between you and Stable Brothers BV, unless and to the extent that there is intent or gross negligence on the part of Stable Brothers BV.
Article 9. Personal data
The legal requirements regarding the protection of personal data, as laid down in the Personal Data Protection Act / the Personal Data Protection Act, are complied with by Stable Brothers BV. If the customer wishes to view, correct or delete his or her personal data, the customer can contact Stable Brothers BV about this. Stable Brothers BV will provide the customer with the requested information or adjust the database in accordance with the customer's wishes.
Article 10. Force Majeure
Without prejudice to its other rights, Stable Brothers BV has the right, in the event of force majeure, to suspend the execution of your order or to dissolve the agreement without judicial intervention, at its own discretion, by notifying you of this in writing and without Stable Brothers BV being liable for any damages, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness. Force majeure is understood to mean any shortcoming that cannot be attributed to Stable Brothers BV, because it is not due to its fault and is not its responsibility under the law, legal act or generally accepted views.
Article 11. Miscellaneous
If you provide Stable Brothers BV with an address in writing, Stable Brothers BV is entitled to send all orders to that address, unless you provide Stable Brothers BV with another address in writing to which your orders should be sent. If Stable Brothers BV has permitted deviations from these Conditions for a short or long period of time, either tacitly or otherwise, this does not affect its right to subsequently demand immediate and strict compliance with these Conditions. You can never assert any right on the grounds that Stable Brothers BV applies these Conditions flexibly. If one or more of the provisions of these Conditions or any other agreement with Stable Brothers BV are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new legally permissible comparable provision to be determined by Stable Brothers BV. Stable Brothers BV is authorised to make use of third parties in the execution of your order(s).
Article 12. Applicable law and competent court
All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law. All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
